My mother has share in two properties in kandiwali . On her death without a will ,she left 4 legal heirs ... my father and we three brothers .father and two brothers prepared a relese deed and transfered there rights and share in favour of father. My name is not there in the release deed , and in the legal heir affidavit they have mentioned that they are only three surviving legal heirs of my mother. After this fraudulent release deed they made father gift all the property to one of the brothers . The society on receipt of my notice has objected , but My brother got a exparte order from the Registrar. My question is . 1) can I get the relese deed rectified through a court order.and get my name added in the same . 2) as my two brothers are releasing there rights will my share in the said property go up . 3) how to cancel the said gift deeds.
With a copy of the Release Deed and then a copy of the Gift Deed of your father, make a Testamentary Petition in Bombay High Court, in Testamentary Division, by appointing a good advocate, who is well versed with this work. Surely you will get 25% of the two properties of your late mother.
