Can a joint owner of a flat in a cooperative housing society make a nomination? Two joint owners in dispute own 50% of the shares of the flat. The second owner is not a member of the society and wants to make a nomination.
Dear Mr Mascarenhas, In buying a flat jointly by two persons, in the Sale Deed of the flat, the person whose name stands second, should necessarily become a Co-Member of that flat. To become a Co-Member, the second-named joint owner should submit Form Appendix-5, which is the Associate Member's form, and pay to the society, Rs.100/- by crossed cheque, as Co-membership entrance fee. In Appendix 5, the joint buyer should write Co-Member at all the places where Associate Member is written. This form he should submit in two copies to the Society. When he submits the form of Appendix-5, he is eligible to fill the nomination form in Appendix-14 in triplicate, for his 50% part of ownership of the flat. Let joint buyer of said flat do all above works.
