Satyender Jain Gets Interim Bail on Medical Grounds: Report

The Supreme Court on Friday granted interim bail on medical grounds to Aam Aadmi Party (AAP) leader Satyendar Jain. The former cabinet minister in Delhi government has been under custody since May 2022 as an undertrial in a money laundering case. 
 
According to a report from LiveLaw, a vacation bench comprising Justice JK Maheshwari and Justice PS Narasimha granted interim bail for six weeks for Mr Jain to get treated in a private hospital of his choice. The bail will be subject to conditions imposed by the trial court. The bench added that Jain should not go to the media to make any statement on any issue and that he shall not attempt to influence the witnesses, the SC says.
 
The bench did not accept the enforcement directorate (ED)'s objection that the AAP leader should be independently evaluated by the AIIMS Delhi, saying that this plea could be considered later. The matter will be considered next on 11th July when the bench will consider Mr Jain's latest medical reports, the report says.
 
Senior advocate Abhishek Manu Singhvi represented Mr Jain, and additional solicitor general (ASG) SV Raju represented the ED.

On 18th May, Mr Singhvi had submitted before the apex court that Mr Jain has extreme health problems, he has lost over 30 kgs and is a skeleton now.

In April this year, the Delhi high court (HC) dismissed the bail pleas of Mr Jain and his two aides in a money laundering case being probed by the ED.

Justice Dinesh Kumar Sharma said that Mr Jain is an influential person and cannot be said to have satisfied the twin conditions for bail under the prevention of money laundering act (PMLA).

"The simple fact is the CBI has filed a case of disproportionate assets (DA). The present court cannot go into the validity of these proceedings. Facts show that certain DA was masked. The court has to see the prima facie case. The broad probabilities indicate that the companies associated with him are controlled and managed by him. Learned special judge order (rejecting bail to Jain) does not have any perversity. Order is well reasoned," the judge had said.

Mr Jain has been in custody since 30 May last year. A trial court had, on 17 November 2022, dismissed the AAP leader's bail application.
