MahaRERA asks DSK to pay interest on pre-EMIs and booking amount to a Pune buyer

The Maharashtra Real Estate Regulatory Authority (MahaRERA) has asked Deepak Sakharam Kulkarni of the DSK Group to pay all pre-equated monthly installment interest and an interest on booking amount paid by a buyer. DSK has to pay the interest till it hands over the possession to the flat owner.
 
In its final order, the MahaRERA Coram headed by BD Kapadnis has asked DSK Group to pay an interest of 10.05% from July 2017 on Rs4.54 lakh it collected from Ganesh Lonkar and also pay Rs20,000 as costs. 
The complaint was made by Mr Lonkar, who had booked a flat in DSK Mayurban located at Pirangut in Pune. According to the agreement, DSK had promised to give the possession of the flat on or before 30 June 2017.
 
But DSK failed to provide timely delivery of the possession of the flat. As an effect, Mr Lonkar had to also suffer the loss bearing from the consequences of the loan incurred upon that flat and he subsequently made a complaint to the MahaRERA.
 
The DSK Group represented by Adv CD Patwardhan contended that the complaint is non-maintainable since Sharmila Ganesh Lonkar, though a joint purchaser of the flat was not made co-complainant in this matter. Further, Adv Patwardhan also argued that the delay was caused due to some circumstances beyond their control and thus the complaint should be dismissed.
 
MahaRERA, however stated that the complaint is maintainable as there is no conflict of interest between the co-purchasers and also there lies is adverse interest to that of her husband, Mr Lonkar, who is the complainant in this matter.
 
Taking note of all the observations, MahaRERA noted that though the agreement mentioned an extension of six months till 29 December 2017, the DSK failed to deliver possession of flat even by this date. Owing to such defaults, MahaRERA stated that the matter falls under section 8 of RERA. 
 
Further, it instructed DSK to hand over the possession of the flat to Mr Lonkar at the earliest possible.

DSK is a thug ! He has cheated a lot of people. Evasiveness and a lot of lies, fabrication, concoction and money laundering seems to be his forte !
