Pyramid schemes: Daylight robbery

pyramid23

Pyramid marketing companies are looting the public easily, while the government watches. Many countries have banned them outright

On any given day, hundreds of pyramid marketing schemes are cashing in on the greed, ignorance and poor financial literacy of millions of people to rob them of their hard-earned savings. In the absence of proper legislation, regulation or registration requirements, these schemes are able to operate quietly and fly below the radar to build up unsustainable pyramids, project a credible business model and payment structure and a cult-like environment to keep people hooked. They come into public gaze only when the payments stop coming in and the founders inevitably decamp with the money.

They are considered outright frauds and are banned in dozens of countries including the US, UK, Canada, China, Iran, Mexico, most of the European Union, South Africa, many Latin American and East Asian countries as well as Australia, Nepal and Sri Lanka. On the other hand, countries such as Singapore ban pyramid companies but permit multi-level marketing (MLM) or direct selling firms to operate, subject to stringent regulation. The difference between the two is subtle and even big MLM names, such as Amway, Tupperware and Avon, are often viewed with a great deal of suspicion and face frequent litigation. Worse, many a time, it is claimed that only influential people, such as doctors or teachers, who are able to recruit more and more distributors, make money. India, however, is a happy hunting ground for pyramids as well as MLMs.

On paper, we have a statute and a Supreme Court judgement to stop pyramids on their tracks. Section 2 (c) of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, specifically covers all schemes promising quick and easy money based on enrolment of new members.

If that weren’t enough, the Supreme Court of India observed, in the case of Kuriachan Chacko and Ors. Vs. State of Kerala (JT2008(7)SC614) that promoters of the scheme (aka, pyramid) knew they were making ‘tall promises’ which would only work for some time. And, that they were operating on the basis that ‘Paul can be robbed to pay Peter’ but, “ultimately, when there is a large mass of Peters, they will be left in the lurch without any remedy as they would by then have been deceived and deprived of their money.” So the principle of what constitutes a dubious lure is enshrined in the statute and ratified by the apex court.

Why then do pyramid marketing schemes proliferate with impunity in India? Because, although there is a Union statute barring money circulation schemes, it is for state governments and the police to initiate action. And most pyramid schemes work to ensure that influential people in government and the police are part of their network. For instance, when City Limouzine, a Mumbai-based Ponzi scheme, folded up after three years, it was discovered that almost 6,000 policemen had been entrapped by its promise of high returns. Even Speak Asia, which has triggered a national furore, has been enrolling policemen. A worried police official in Mumbai has even started a blog to warn fellow officers not to be fooled by the scheme.

Over the past decade, the only decisive action against pyramid schemes has been initiated by the Andhra Pradesh police, mainly under DIG (deputy inspector-general) of police, VC Sajjanar. He went after Japan Life (which sold magnetic mattresses for a whopping Rs1.32 lakh), Gold Quest (sold what it claimed were two numismatic coins at Rs30,000) and a few others. The Orissa police also blocked a similar scheme that raised over Rs1,000 crore from the poorest villages not too far from the Bangladesh border. In many cases, they initiated action under the Money Circulation Act, along with Section 420 of the Indian Penal Code as well as relevant sections of the Drugs and Cosmetics Act, 1940, and the Drugs and Magic Remedies Objectionable (Advertisement) Act, 1954.

Clearly, with no blanket ban or registration and regulatory supervision, pyramid companies can operate freely until they collapse. The police, in most states, especially Mumbai, initiate some desultory action only when investors throng to file complaints after the cheques stop coming in. Even the Reserve Bank of India (RBI), maintains a Sphinx-like silence (as in the case of Speak Asia) or, at best, writes to chief secretaries of various states to initiate action (e.g., after Moneylife wrote to the RBI repeatedly about Gold Quest).

While the government refuses to act, pyramid schemes are getting more brazen, more sophisticated and are running global operations. Also, unlike in the past, when such dubious schemes flew below the radar and spread quietly, Speak Asia, registered in Singapore, was in a tearing hurry. It offered a stunning return of 500% by getting people to fill meaningless surveys and enroll new ‘panellists’—each of whom would pay Rs11,000 to join. Its declared intention was to enrol one crore people by the end of 2011. And it was creating a cult-like following with a mega event at Goa that had Bollywood artists and singers entertaining the panellists, between super-charged speeches by its officers. Speak Asia claimed a Singapore registration and also hired a top PR agency (LinOpinion of Lintas) to launch an advertising blitz in newspapers and on television during IPL (Indian Premier League) cricket matches. Ironically, all it did was to stir up a huge controversy and force the somnolent RBI and the ministry of corporate affairs to launch an investigation. ‘Coercive persuasion’ and ‘brainwashing’ are charges often made about pyramid schemes. It would explain the large number of Speak Asians who post abusive emails against anyone who questions the credibility of its dubious claims. While its minimum joining amount is Rs11,000, there are innumerable examples of people irrationally joining Speak Asia with four to 10 IDs  (read more on the scheme in Current Account, page 15).

Clearly, this cannot be allowed to continue. In a country with low general literacy and abysmal financial literacy, the government cannot act after people have been looted in broad daylight. That is why Moneylife Foundation, our not-for-profit affiliate, has sent a representation to the prime minister seeking an outright ban on all pyramid marketing schemes. Even those who call themselves a part of the Indian Direct Selling Association and are lobbying for legalising MLMs must be subject to statutory registration, regulation, scrutiny and clearance by the Securities and Exchange Board of India (SEBI) or the RBI before starting operations.

So far, the only action is an investigation launched by the ministry of corporate affairs. The Mumbai police have registered a complaint filed by Kirit Somaiya, former member of Parliament, but is waiting for a Speak Asian to complain about not receiving payment. When that happens, it will be too late to recover any money.

There is 1 more company in the list known as RMP which has a huge network in mumbai. I have been approached by many of its members to be a part of this chain. The indian media is investigating companies like speakasia which is in the limelight right now, but there are several companies operating which have a network much larger then speakasia. The media should take responsibility and investigate such companies & bring the truth infront of the citizens of india, so they are not cheated & do not lose their hard earned money.

But probably you don't know that RMP had filed a defamation case also against the same. FICCI, World Trade Center, MSIL, ISO, President of India, CM- Gujrat & and many other reputed awards cannot be had by any xyz company. Such things can happen with the market leader & honest brand like RMP only.

Dear Moneylife, All other commentators this is for u. Request u all to study the business module of SAOL before posting baseless comments. Thank you.

Triple Filter TesT

In ancient Greece, Socrates was reputed to hold knowledge in high esteem. One day an acquaintance met the great philosopher and said, “Do you know what I just heard about your Business & Company?”

“Hold on a minute,” Socrates replied. “Before telling me anything I’d like you to pass a little test. It’s called the Triple Filter Test.”

“Triple filter?”

“That’s right,” Socrates continued. “Before you talk to me about my BUSINESS & COMPANY
, it might be a good idea to take a moment and filter what you’re going to say. That’s why I call it the triple filter test. The first filter is Truth.
Have you made absolutely sure that what you are about to tell me is true?”

“No,” the man said, “Actually I just heard about it and...”

“All right,” said Socrates. “So you don’t really know if it’s true or not. Now let’s try the second filter, the filter of Goodness.
Is what you are about to tell me about my COMPANY & BUSINESS something good?”

“No, on the contrary...”

“So,” Socrates continued, “You want to tell me something bad about him, but you’re not certain it’s true......................... You may still pass the test though,
because there’s Third filter left: the filter of Usefulness.
Is what you want to tell me about my COMPANY & BUSINESS going to be useful to me?”

“No, not really...”

“Well,” concluded Socrates, “If what you want to tell me is neither TRUE Nor GOOD Nor Even USEFUL, why tell it to me at all?”

Usually I dont bother to reply people who had stopped using brains, but since you used my name so many times I thought OK lets give a reply for the benefit of the mankind.

Given the massive losses, failures and harmful consequences, why do so many people have joined Speak Asia? Actually, almost no one “joins” Speak Asia for the e-zine. Nearly all are recruited. They are lured, and the Speak Asia lure of easy money by just filing foolish and childish surveys is nearly irresistible. Here are a few of the most common lures:

#Need for money and income: More people than ever are out of work, don’t earn enough, face foreclosure, possible layoff, or have too much debt. Speak Asia promise a solution, a pathway to income and wealth – a powerful lure when the need is so great.

#False promises and claims: To support the income lure are false claims of easy money, steady income, early retirement and annuity income, all backed with testimonials that “anyone can do it.”

#Hope and Dreams: Promoters tell the new recruits to imagine having a lot of money, to envision purchases they would make, debts they would eliminate, and benefits for family and children. Speakers and recruiters lead people in “dream” sessions in which they are told to remember long forgotten hopes and goals. They lead the newcomers to believe it is all possible with the Speak Asia system. They lead people to believe they are joining a crusade for good and that success is very likely in a “people helping people win/win” business model.

#Trust, or, Can’t Say No: Most people are invited by someone they know, like and trust. Many people join just because it is so difficult to say no to friends, relatives, and colleagues.

#Celebrities Involved, So It Must Be True: Famous and trusted figures sometimes are associated with the MLMs or even endorse them. Politicians take advantage of MLM crowds and give the impression of endorsement; celebrities collect large fees to speak or perform at meetings. Many people believe the schemes are legitimate based on associations with celebrities and authorities.

#Behind the Smoke and Mirrors: While people are responding to friends, imagining wealth, reviving hopes and believing they have a real opportunity, Speak Asia hided the hard facts. They conceal shocking rates of consumer losses, high prices for their products or actual lack of consumer demand for them. They cover up the quitting rates each year, the lack of retail customers, and the high costs of staying in the schemes. They also hide realities of true income – after expenses – of the upper levels who are touted as wealthy. Many turn out to be living on credit cards and “fake it till you make it” lifestyles. Some of the Speak Asia leaders, it turns out, make the majority of their money as speakers and promoters, not from filing surveys or selling products or services. This is kept secret from the recruits who think the leaders became millionaires as salespeople for the company and are worthy role models.

Whatever action has been taken, or is purported to have been taken, as rightly pointed out in this well-argued piece, is nothing but an eyewash by the bureaucracy which is deeply entrenched in the economic anarchy in India. Politicos are bound to be corrupt and dishonest, in fact they cannot help not being meacenaries by the reason of their ocational compulsions of survival. But the danger embedded in a coruupt bureaucracy with naked agenda of plundering the country is a deadly poison. Pyramid companies are thriving essentioally for the greedy bureaucracy which, if interested, should have acted long ago without looking to the political masters' interest in the matter. In other words, the reluctance or failure of the government (read:the bureaucracy) to act in the given context-as in all other cases where the interest of big industry is involved-does not indicate any incapability but its allegiance to big business.

MLM companies - Excerpts from Andhra Police Press Release:-

It is every duty of the citizen to educate the public, as such companies not only destroy the economic fabric of our country but also the fiscal system of our nation. More damaging is that MLM schemes destroy the well knitted social fabric of our Indian society and make your house as well as your neighborhood a market.

I fully subscribe with the views of Ms Sucheta Dalal. It is heartening to note that she has taken interest in unravelling the fraud in these schemes. Big names like Amway Tupperware seemingly escape the legal loopholes as they sell 'FMCG products' that are highly priced with little margins. If these companies are confident of their product quality, why not sell it in the conventional manner? The same is the case of teak plantation companies and other companies of the likes of Golden Forests, Sterling Tree Magnum who have amassed huge sums in the past decade and have never repaid a single rupee to the investors. Hope Money Life will start a new campaign to salvage atleast the invested money to the hapless investors.

SpeakAsia is not the only fraud out there.

Perhaps people forgot about TVI Express refunding 6000 participants in March of 2010 after FIR was filed with Sikkim police .

TVI Express have also once enrolled the police chief of Java, Indonesia as a member, with his picture featured prominently at local recruitment drives.

SpeakAsia is suspicious, but it has NOT been outright convicted of any fraud thus far.

Same cannot be said of TVI Express. Its members HAD BEEN convicted of fraud in China (9 went to jail already), and pending cases are all over the world, including Australia, Tajikstan, South Africa, Georgia (country), USA, and many more countries.

And they use the exact same tactics: present itself as one thing, but when questioned, claim to be something else. What's even more interesting: TVI Express never officially published who is their CEO or ANYBODY in their management team. At least with SpeakAsia you have CEOs giving SOME answers, even though they sound like lies.

Why is there no national agency in India like the SEC in the US that goes after business frauds?

I am really wondering how come so many people try to create a wrong attitude...

When they join it, there a heaps of praises on that company and once there is a problem they say they cheat. The reason is they dont even think or check the background of the company.

Coming to MLM's the furture is fully on this concept towards which the world is moving on...so those who give wrong information and give false are only losers.

Amway is one of the MLM, its a network markeking started in 1959 and its spread across 100 countries.

1) All products are environment friendly
2) All products are cost effect and you can save a lot of money (only those who consume will understand else only will talk crap)
3) 100% Product statisfaction or money refund within 30 days(So what is the problem here?)
4) Amway does a turnover of 9.3 US Billion $, (approx 60000 crores per year)
5) The founders where the president of the US chamber of commerce (What a prestigious position to be held)
6) Nuritlite - The world's best supplements and rate the No.1 ( 75 yr company producing supplements on their own farm land - You can never imagine the process and the quality its followed)
7) All Nutrilite awarded by WHO
8) Amway received the World Environmently Award for its products
9) There is no country or territory it had taken back its foot where they have entered.
10) There were so many cases against but all where proved false. Even the Federal court in US have approved this plan and have given this is the best plan a business can have.
11) Amsure - the Insurance they provide is tried up with Max New York which is another huge giant.
12) Finally please justify before given any wrong information whether you are qualified to talk about such a compnay.

I advise people on this forum to read the Rich Dad Poor Dad, also see the vidios on you tube Rich Plan Poor Plan by Rober Kiyasaki (A world class econimist) or still you would like to listen to your broken friends and relatives.

Just because some VIPs (from US) are involved does no,t make it any cleaner. If you join Amway you are forced to buy products which you do not want, and then continue to force your friends to buy them just to recover your loss. Where is the need for this kind of schemes? Is it adding any value to our life?

Mr Prem, Only words won't suffice. Substantiate your facts by giving links to official document to make it verifiable. For example when u say that that US Federal Court has approved that this is the best plan a business can have-- upload that particular ruling of Federal Court in a link to make everybody see it.

Last line in their "rewards" FAQ (below) proves that they are MLM and do not have any other income stream.

==
Q3) How do I redeem my reward points from the company?

A:The reward points can be redeemed for buying trainings, e-zine subscriptions, products and services offered by the company. Un utilized reward points can also be transferred from your e wallet to your bank account within 7-14 working days (depending upon the local bank in India). Amounts are credited in your local currency by the bank. A bank transfer charge at the rate of 3% is applied subject to a minimum of USD7.5 . Total cash request in a year cannot exceed your *referral income* from sale of e-zines.

The clarification on the same was posted by the SAOL in its popup but somehow was not rectified on the site. Let's wait for the new website. Because I am also concerned about this more than you do as I have already put in the money there.

There is a difference between "cycler recruiting" and "multi-level marketing". One is legal, the other is not. I believe you proved that SpeakAsia is cycler recruiting.

Besides blaming the Pyramid scheme promotors, let us also try to enquire why, educated people are continuing to fall for these frauds despite wide publicity being given to similar failed schemes. If people allow themselves to be fooled because of their greed, they have only themselves to blame.

Pyramid Scheme Alert 11 months ago
http://pyramidschemealert.org/
Given the massive losses, failures and harmful consequences, why do so many people join MLMs?

Actually, almost no one “joins” multi-level marketing. Nearly all are recruited. They are lured, and the MLM lure is nearly irresistible. Here are a few of the most common lures:

#Need for money and income: More people than ever are out of work, don’t earn enough, face foreclosure, possible layoff, or have too much debt. MLMs promise a solution, a pathway to income and wealth – a powerful lure when the need is so great.

#False promises and claims: To support the income lure are false claims of easy money, steady income, early retirement and annuity income, all backed with testimonials that “anyone can do it.”

#Miracle Products: MLM promoters often tout their products as miracle cures for cancer, diabetes, obesity, or arthritis, etc. They say the products “sell themselves.” Others promote “new technology” that they claim “everyone will have in their homes.”

They lead the newcomers to believe it is all possible with the MLM system.

Politicians take advantage of MLM crowds and give the impression of endorsement; celebrities collect large fees to speak or perform at meetings; authors hawk books at the MLM meetings adding their credibility. Even famous religious figures may offer prayers at meetings, implying a holy stamp of approval. Many people believe the schemes are legitimate based on associations with celebrities and authorities.

#Behind the Smoke and Mirrors: While people are responding to friends, imagining wealth, reviving hopes and believing they have a real opportunity, the MLMs hide the hard facts. Some of the MLM leaders, it turns out, make the majority of their money as speakers and promoters, not from selling products or services. This is kept secret from the recruits who think the leaders became millionaires as salespeople for the company and are worthy role models.

SpeakAsian 11 months ago
Hey Guys... Have an excellent news for all the Speak Asians. An insider source has revealed that the payouts will begin by 15th of July. Also the company's PE in India is going to be by July End. The Company met with some of the members of MCA, and explained the concept and the business plans. They have got a green signal from the Ministry as there is no fault in the system, except that they have to deduct TDS from valid incomes. So Speakasia is soon going to get the Pan card Accounts of the members. The business is as legitimate as any other business can be. Even in stock markets some shares give you returns over 1000% in 6 months, so no questions on the Business model or how can it give so much return. Also came to know that, in fact the money company makes out of selling these survey reports is in itself sufficient to pay the panelists. The only reason it charges 11000/- is to ensure that the members are legitimate and genuine. Or else, just imagine, if they do not charge this amount, they will have members like something and will generate erroneous reports with ofcourse, someone who is paying for these survey to speakasia will not accept such reports. Also, there is a news that some big Indian industrial corporation is going to back SpeakAsia soon. Had they wanted to run, they would have run by now. And people like manoj and all, why will they destroy their careers being with this company if it was not legitimate.

Keep these things in mind, these are reports from the most internal sources and you will find them spread across within a few days.

As to how i know all this, you will very soon find that out.

Just have faith, your hard earned money will not go anywhere.
And remember, Pro SpeakAsia/ Anti Speakasia, whatever, you people need to realise how much business have you generated for moneylife. Speakasia is the only news Item they have. Nothing else. Moneylife's online revenues are soaring high with each click we make.

Regards

Speakasian.

Dear Ms. Dalal,

Would like you to please trace SAOL Management and confirm the following statements which they have been giving in the various confrences being held all over india. To trace the management , you may please catch them at any of the conference being organized now a days.

1) The company is establishing its PE in India at Goregaon and interiors is already in place. Is it ready or not???

2) The company has applied to RoC for registration of three subsidiaries with 75% stake of paid up capital coming from Haren Ventures and Balance 25% by top Management of SAOL. Is RoC aware of this?

3) The company is about to launch its new website with e-commerce facilties. Is there any legal compliance required before launching such websites, if yes, please let us know the same.

Being a journalist , I hope you can confirm the above news through your sources as you have enough resources
We will be fully supporting you in these initiatives and this will help stop crap coming to your website. If above are not true, I would be the first one to file the complaint with police.
As regards your above article on pyramid schemes, it would be relevant to mention that pyramids exist everywhere. Every corporate organization has a pyramid. You cannot have more than one chief editor but you can have more than one data entry operator. You cannot have more than one CFO in an organization but more than one GMs and larger no. of AGMs and even larger no. of Executives down the line. How a pyramid works is the moot question and not that it exists. If you could please do a detailed investigation on how this pyramid is being managed by Speak Asia and the way it is managed by other companies like Ram Survey and Pratibha Survey, you would be in a much better position to substantiate your thoughts.

We fully respect your intent behind these articles but do not support the way these are presented. You as part of media should be able to distinguish good apples from bad ones.

The 10 Big Lies of Multi-Level Marketing
http://www.consumerfraudreporting.org/cf....
Copyright 1997, Robert L. Fitzpatrick

The multi-level marketing (MLM) field grows and its member companies multiply. Solicitations to join the movement seem to be everywhere. The impression accordingly grows that it is indeed the wave of the future, a business model that is gaining momentum, growing in acceptance and legitimacy and, as its promoters claim, will eventually replace most other forms of marketing and sales. Many are led to believe the assertions that success can be found by anyone who faithfully believes in the system and steadfastly adheres to its methods and that eventually all of us will become MLM distributors.

With fourteen years experience in corporate consulting in the distribution field and after more than six years of research and writing about the MLM model, I have gathered information, facts and insights that show the MLM business model to be essentially a free market hoax. It is analogous to calling the purchase of a lottery ticket a \'business venture\' and winning the lottery a \'viable income opportunity for everyone.\' MLM industry claims of distributor income potential, its glorified descriptions of the \'network\' business model and its prophecies of a reigning destiny in product distribution have as much validity in business as UFO sightings do in the realm of science.

The very legality of the MLM system rests tenuously upon a single 1979 court ruling on one company. The guidelines for legal operation set forth in that ruling are routinely ignored by the industry. Lack of governing legislation or oversight by any designated authority also enables the industry to endure despite occasional prosecutions by state Attorneys General or the FTC.

MLM\'s economic score card is characterized by massive failure rates and financial losses for millions of people. Its structure in which positions on an endless sales chain are purchased by selling or buying goods is mathematically unsustainable and its system of allowing unlimited numbers of distributors in any market area is inherently unstable. MLM\'s espoused core business - personal retailing - is contrary to trends in communication technology, cost-effective distribution, and consumer buying preferences. The retailing activity is, in reality, only a pretext for the actual core business - enrolling investors in pyramid organizations that promise exponential income growth.

As in all pyramid schemes, the incomes of those distributors at the top and the profits to the sponsoring corporations come from a continuous influx of new investors at the bottom Viewed superficially in terms of company profits and the wealth of an elite group at the pinnacle of the MLM industry, the model can appear viable to the uninformed, just as all pyramid schemes do before they collapse or are prosecuted by authorities.

Deceptive marketing that ably plays upon treasured cultural beliefs, social and personal needs, and some economic trends account for MLM\'s growth, rather than its ability to meet any consumer needs. The deceptive marketing is nurtured by a general lack of professional evaluation or investigation by reputable business media. Consequently, a popular delusion is supported that MLM is a viable business investment or career choice for nearly everyone and the odds of financial success in the venture are comparable or better than other trades, professions, employment or business ventures.

MLM\'s true constituency is not the consuming public but rather hopeful investors. The market for these investors grows significantly in times of economic transition, globalization and employee displacement. Promises of quick and easy financial deliverance and the linking of wealth to ultimate happiness also play well in this market setting. The marketing thrust of MLM is accordingly directed to prospective distributors, rather than product promotions to purchasers. Its true products are not long distance phone services, vitamins or skin cremes, but rather the investment propositions for distributorships which are deceptively portrayed with images of high income, low time requirements, small capital investments and early success.

Lie #1: MLM is a business offering better opportunities for making large sums of money than all other conventional business and professional models.

Truth: For almost everyone who invests, MLM turns out to be a losing financial proposition. Less than one percent of all MLM distributors ever earn a profit and those earning a sustainable living at this business are a much smaller percentage still.

Extraordinary sales and marketing obstacles account for much of this failure, but even if the business were more feasible, sheer mathematics would severely limit the opportunity. The MLM type of business structure can support only a small number of financial winners. If a 1,000-person downline is needed to earn a sustainable income. Those 1,000 will need one million more to duplicate the success. How many people can realistically be enrolled? Much of what appears as growth is in fact only the continuous churning of new enrollees. The money for the rare winners comes from the constant enrollment of armies of losers. With no limits on numbers of distributors in an area and no evaluation of market potential, the system is also inherently unstable.

Lie #2: Network marketing is the most popular and effective new way to bring products to market. Consumers like to buy products on a one-to-one basis in the MLM model.

Truth: If you strip MLM of its hallmark activity of continuously reselling distributorships and examine its foundation, the one-to-one retailing of products to customers, you encounter an unproductive and impractical system of sales upon which the entire structure is supposed to rest. Personal retailing is a thing of the past, not the wave of the future. Retailing directly to friends on a one-to-one basis requires people to drastically change their buying habits. They must restrict their choices, often pay more for goods, buy inconveniently, and awkwardly engage in business transactions with close friends and relatives. The unfeasibility of door-to-door retailing is why MLM is, in reality, a business that just keeps reselling the opportunity to sign up more distributors.

Lie #3: Eventually all products will be sold by MLM. Retail stores, shopping malls, catalogues and most forms of advertising will soon be rendered obsolete by MLM.

Truth: Less than 1% of all retail sales are made through MLM and much of this sales volume is accounted for by the purchases of hopeful new distributors who are actually paying the price of admission to a business they will soon abandon. MLM is not replacing existing forms of marketing. It does not legitimately compete with other marketing approaches at all. Rather, MLM represents a new investment scheme that uses the language of marketing and products. Its real products are distributorships which are sold with misrepresentation and exaggerated promises of income. People are buying products in order to secure positions on the sales pyramid. The possibility is always held out that you may become rich if not from your own efforts then from some unknown person who might join your \'downline,\' the \'big fish\' as they are called.

MLM\'s growth is a manifestation not of its value to the economy, customers or distributors but of the recently high levels of economic fear and insecurity and rising expectations of quick and easy wealth. It is growing in the same way legalized gambling and lotteries are.

Lie #4: MLM is a new way of life that offers happiness and fulfillment. It is a means to attain all the good things in life.

Truth: The most prominent motivating appeal of the MLM industry as shown in industry literature and presented at recruitment meetings is the crassest form of materialism. Fortune 100 companies would blush as the excess of promises of wealth and luxury put forth by MLM solicitors. These promises are presented as the ticket to personal fulfillment. MLM\'s overreaching appeal to wealth and luxury conflicts with most people\'s true desire for meaningful and fulfilling work in something in which they have special talent or interest. In short, the culture of this business detours many people from their personal values and desires to express their unique talents and aspirations.

Lie #5: MLM is a spiritual movement.

Truth: The use of spiritual concepts like prosperity consciousness and creative visualization to promote MLM enrollment, the use of words like \'communion\' to describe a sales organization, and claims that MLM is a fulfullment of Christian principles or Sciptural prophecies are great distortions of these spiritual practices. Those who focus their hopes and dreams upon wealth as the answer to their prayers lose sight of genuine spirituality as taught by all the great religions and faiths of humankind. The misuse of these spiritual principles should be a signal that the investment opportunity is deceptive. When a product is wrapped in the flag or in religion, buyer beware! The \'community\' and \'support\' offered by MLM organizations to new recruits is based entirely upon their purchases. If the purchases and enrollment decline, so does the \'communion.\'

Lie #6: Success in MLM is easy. Friends and relatives are the natural prospects. Those who love and support you will become your life-time customers.

Truth: The commercialization of family and friendship relations or the use of \'warm leads\' which is required in the MLM marketing program is a destructive element in the community and very unhealthy for individuals involved. Capitalizing upon family ties and loyalties of friendships in order to build a business can destroy ones social foundation. It places stress on relationships which may never return to their original bases of love, loyalty and support. Beyond its destructive social aspects, experience shows that few people enjoy or appreciate being solicited by friends and relatives to buy products.

Lie #7: You can do MLM in your spare time. As a business, it offers the greatest flexibility and personal freedom of time. A few hours a week can earn a significant supplemental income and may grow to a very large income making other work unnecessary.

Truth: decades of experience involving millions of people have proven that making money in MLM requires extraordinary time commitment as well as considerable personal skill and persistence. Beyond the sheer hard work and talent required, the business model inherently consumes more areas of ones life and greater segments of time. In MLM, everyone is a prospect. Every waking moment is a potential time for marketing. There are no off-limit places, people or times for selling. Consequently, there is no free space or free time once a person enrolls in MLM system. Under the guise of creating money independently and in your free time, the system gains control and dominance over people\'s entire lives and requires rigid conformity to the program. This accounts for why so many people who become deeply involved end up needing and relying upon MLM desperately. They alienate or abandon other sustaining relationships.

Lie #8. MLM is a positive, supportive new business that affirms the human spirit and personal freedom.

Truth: MLM is largely fear-driven. Solicitations inevitably include dire predictions about the impending collapse of other forms of distribution, the disintegration or insensitivity of corporate America, and the lack of opportunity in other professions or services. Conventional professions, trades and business are routinely demeaned and ridiculed for not offering \'unlimited income.\' Employment is cast as enslavement for \'losers.\' MLM is presented as the last best hope for many people. This approach, in addition to being deceptive, frequently has a discouraging effect on people who otherwise would pursue their own unique visions of success and happiness. A sound business opportunity does not have to base its worth on negative predictions and warnings.

Lie #9. MLM is the best option for owning your own business and attaining real economic independence.

Truth: MLM is not true self-employment. \'Owning\' an MLM distributorship is an illusion. Some MLM companies forbid distributors from carrying additional lines. Most MLM contracts make termination of the distributorship easy and immediate for the company. Short of termination, downlines can be taken away with a variety of means. Participation requires rigid adherence to the \'duplication\' model, not independence and individuality. MLM distributors are not entrepreneurs but joiners in a complex hierarchical system over which they have little control.

Lie #10: MLM is not a pyramid scheme because products are sold.

Truth: The sale of products is in no way a protection from anti-pyramid scheme laws or unfair trade practices set forth in federal and state law. MLM is a legal form of business only under certain rigid conditions set forth by the FTC and state Attorneys General. Many MLMs are in gross violation of these guidelines and operate only because they have not been prosecuted. Recent court rulings are using a 70% rule to determine an MLM\'s legality. At least 70% of all goods sold by the MLM company must be purchased by non-distributors. This standard would place most MLM companies outside the law. The largest of all MLMs acknowledges that only 18% of its sales are made to non-distributors.

The 10 Big Lies of Multi-Level Marketing and How SAOL is not affected by any of these

This is a posting on the web where in Robert L. Fitzpatrick (http://www.consumerfraudreporting.org/cf....
Copyright 1997, Robert L. Fitzpatrick) has tried to explain why we should not fall in the trap of MLMs. I am trying to compare business model of Speak Asia Online Limited (SAOL) against each of the arguments below. Hope the readers will appreciate and post their views on the same.

SAOL – As per current business model of SAOL , there is no compulsion of referring any one and whatever you earn is as per your capacity and understanding of the model. If you want to stay indoors and not want extra extra income you need not refer any one. And as per SAOL Management , they are now a self sustained team of panelists and even if no new joinings happen now onwards they will be able to succeed in their business plans. As per SAOL Model, none of panelists will be in loss there is an option of fixed income which will be higher than amount paid for getting enrolled and this fixed income is not dependent on getting new distributors enrolled.

The unfeasibility of door-to-door retailing is why MLM is, in reality, a business that just keeps reselling the opportunity to sign up more distributors.

SAOL – True The company will be using the existing panelists as distributors but it is building its own force of Sales Managers also which will be on the payrolls of the company and will work for recruiting the new panelists / book new orders for their products to be launched through their E-commerce site. Yes SAOL will also be launching new products and create its own brand YUG, but the company is arranging to sell the products of the existing brands also as per the current updates from management. Once the new website comes up, this will be more clear. As of now SAOL doesn’t fall into the definition of MLM because
a) The choice of products will not be restricted here.
b) Retailing of products is not compulsory
Lie #3: Eventually all products will be sold by MLM. Retail stores, shopping malls, catalogues and most forms of advertising will soon be rendered obsolete by MLM.

Truth: Less than 1% of all retail sales are made through MLM and much of this sales volume is accounted for by the purchases of hopeful new distributors who are actually paying the price of admission to a business they will soon abandon. MLM\'s growth is a manifestation not of its value to the economy, customers or distributors but of the recently high levels of economic fear and insecurity and rising expectations of quick and easy wealth. It is growing in the same way legalized gambling and lotteries are.

SAOL: The company is not targeting to render the existing medium obsolete rather it is trying to empower the consumers by giving them the choice to participate in the various business activities like
1) Giving Opinions
2) Watching On Line Advertisements
3) Referring New Panelists
4) Buying the products online at a considerable discount from MRP
5) Recommending those products to the Non-Panelists
6) Narrow Casting – Booking Classifieds for the existing businesses available in the market place
7) Some more options will be added soon

Lie #4: MLM is a new way of life that offers happiness and fulfillment. It is a means to attain all the good things in life.

Truth: The most prominent motivating appeal of the MLM industry as shown in industry literature and presented at recruitment meetings is the crassest form of materialism. Fortune 100 companies would blush as the excess of promises of wealth and luxury put forth by MLM solicitors. These promises are presented as the ticket to personal fulfillment. In short, the culture of this business detours many people from their personal values and desires to express their unique talents and aspirations.

SAOL: There is a capping put by the company on the amount a panelist can earn in a day and there is no scope of unlimited income

SAOL: This is not at all applicable for Business of SAOL. This is a pure business model and is no way related to spirituality.

SAOL: The company’s business model is giving various options to the panelists to increase their sources of income but the source of income is no where dependent on the strength of downlines. Every panelist can participate in the business activities of the company for captive use also and need not depend on friends and relatives.

SAOL: SAOL is a pure business activity and can be taken as a full time option from day one and need not be done only in spare time. If you have joined any MLM and SAOL in particular you have agreed to become a sales person only and every person who is in the sales and marketing field will always try to sell their products / services to the common public only. Suppose you are employed as Sales Manager for the sale of computers in a Big Company called apple/Microsoft won’t you ask your team of distributors and your down the line employees to find leads from their sources and general public. The same is the case for MLMs

SAOL: The business is based on empowering consumers model and this model just tries to improve upon the existing distributorship channels and try to give middlemen commissions/incentives to the end consumer. Since SAOL is targeting sales of not only its own brand but also the brands available in the market , the ratio of success increase manifolds since the people need not build confidence of the prospect in the brand first and then achieving sales.

SAOL: The company is not dependent on its own unique products but is a building a platform where in the like minded consumers are united and economies of scale are achieved and income is provided in the form of savings on purchase cost of daily to use products

SAOL: Every business is a pyramid be it SAOL, MLM or any other traditional business. Every Corporate structure has lower number of persons at top and larger numbers in the lower scale. The labour building a bridge is in huge numbers and is lowly paid. If some of them understand how their seniors are working and are willing to be in their footprints they get promoted as supervisors and become highly paid than their fellow workers and keep on climbing the corporate ladder over a period of time. If this pyramid hierarchy is acceptable in traditional business then why such hype is created on SAOL type of businesses ? Infact SAOL and other businesses accumulate much bigger numbers at the lower levels as compared to the traditional businesses in very short span of time so this is highlighted.
My fellow readers are requested to please post their comments either negative or positive on the above. These will be highly appreciated. Please don’t use any abusive words in your comments because those will be removed.

The problem with SpeakAsia is it CANNOT claim to be a MLM at all.

Why? Because it sells NO PRODUCT TO CONSUMERS (non-members).

Thus, Sanjeev's explanation is completely useless. It is a "strawman", one of the many logical fallacies. it is very often used by scammers to justify the scam.

Ok. Why don't you waive the joining fees. That way it can be called fair game.

Suggestion: Next time write little less in your comments. Nobody has time to read an article in the comment :-)

@Sanjeev -- Unfortunately, what you claim is completely different from what SpeakAsia's website says.

So either you are a high SpeakAsia official able to waive fees at will, or you are a liar out to spread lies to make SpeakAsia look better.

If you have a third explanation (such as you are stupid and made a mistake), let us hear it.

Dear Chang,

They have said the same in press confrence also and in their FAQs also. Kindly visit tinyurl.com/spkfaq.

Ques> Why is the company refraining from the word ‘Investment’? what is E-Zine subscription? Why is company charging for the subscription of a Magazine? How is it helpful to the panelists? (overall info on E-Zine Magazine)
Ans>> The company is refraining from the word investment, because participating in SAOL absolutely cannot be classed as an investment. Speak Asia is creating an online Panel community of “Empowered consumers” which earns rewards points (RP’s), by participating in various companies activities.e.g. Surveys filling, product referrals / sales, advertising based surveys, self development training programs. This is not a guaranteed return and varies from panelist to panelist based upon their individual efforts.

Speak Asia gets research done ‘on’ and ‘for’ different companies, products and services. Panelists earn reward points (RP) for participating with their valuable opinions in the surveys. Thus the panelist gets money in lieu of the surveys they file as per SAOL Terms & Conditions. It is not an investment scheme, where panelists invest money and they get a return on it.Thus our business structure does not fall into the category of any investment scheme.

In fact it has been very clearly communicated by the company right from the beginning that people join SAOL for free. The 3 ways to join and participate on the SAOL portal are: To produce an income statement from any of the global top 20 online survey companies, showing an annual income of $1000 or more and join SAOL for free.

By appearing and passing a test and an interview one can join SAOL for free.

By subscribing to E-zine “Surveys Today” for Rs.6, 000 for 6 months subscription and Rs. 11,000 for a yearly subscription one can join SAOL for free.

e-zine “Survey Today” is a magazine Globally Distributed by Haren Ventures Pte. Ltd Singapore (HVP), which contains information about various products and services and market research techniques etc. The sum of Rs 1,000/- or 6,000/- or 11,000/- that the panelists pay is for various types of subscription of the e-zine “Survey Today” and this is not an investment.

The subscription to the e-zine is only one of the three ways which makes the panelist eligible to join SAOL portal for FREE.

It is entirely the prerogative of the panelist to choose any one of the three ways mentioned above to become a Free panelist at SAOL.

Hope this solves your query mr. chang. For more such clarifications do visit the above site or read my blog at http://tinyurl.com/sanjspk

Dear Sanjeev,

You clearly do not read SpeakAsia website very clearly:

The examination fee is 60 reward points.

http://www.speakasiaonline.com/register....

The exam itself is NOT FREE. So the statement "take the test and join for free" is misleading and wrong.

It makes me wonder what other misleading statements you have also stated.

Sanjeev Khanna 11 months ago  in reply to KChang
Chang,
Do you think everyone who sits for exam can qualify? 60 Reward Point is only exam fees which if translated to rupee is only 3,000 rs approx. And this 3,000 rupees is taken for conducting exam where all administrative costs are involved and to recover these costs 3,000 is what the company charges. If you are able to clear the exam then your joining is free. But if u are unable to clear the same is forfeited.
Joining is always free.
You can not link exam fees with joining. These are two seperate things.
Arguments are a plenty but somehow I feel you are ruing the fact that you missed to join it on time.
Please be assured that everything you do in life has its positives and negatives and when positives outweigh negatives, you can do that job. As per my risk appetite 11,000 is not that big a sum which will force me look into these small negatives when there are huge positives present. Because if I lose only 11000 is the sum I will be deprived of. But If company is able to fulfill whatever they have committed, then my income would be much more than 11,000 and that too as a side income where I need not put in regular purchases again like AMWAY.
But people like you help us make aware of the negatives which are present and we are forwarding all these to management wherever possible to remove. Keep on posting your thoughts and help us in getting rich.Wait for few more weeks and I hope consumer empowerment will become the buzz word now onwards..
Speak asia is a panel exchange program and is somehow different from the other MLMs which came in India till now. I have written very detailed replies in my blog and can continue to argue here also. But then is it of some use to any of you, I don't know.
Remember in Speak Asia Model I am not dependent on my downline to earn my regular fixed income. The only help I get from downline is that the amount of extra income increases fast. 20 Lakh people are sufficient for speak asia to continue its business model but always there is greed that if we can earn something more then why not ???

If speakasians are greedy than what about Mayawati and Ratan Tata who are unmarried and don't have any family which they have to support. Even then they are working hard as per their skill to accumulate wealth. If we are greedy than let it be..
In case you want some further detailed explanation, you can regularly visit my blog at htpp://tinyurl.com/sanjspk which I will be updating regularly based on valid logics and clarifications we keep on receiving from management. And after reading this if anyone wishes to join speakasia they are most welcome to leave a comment in my blog and I will contact them and clear whatever their remaining doubts are. If speakasia had to run away, they would have done it by now. But they are fighting back and hence we are supporting them.

Dear Ms. Dalal,

Let me clarify some facts before you continue with your witch hunt and personal vendetta against SpeakAsiaOnline :
1. This is not a collective investment scheme / ponzi scheme / pyramid scheme / MLM as you so delight in calling it in your articles since October 2010.

The Rs.11,000/- is charged for a "subscription" to an Ezine for a year (2 ezines per week working out to 104 issues in a year and about Rs.96.15p per issue). These ezines are an aid to doing the surveys and enhance the knowledge of the panelists about the products / services / issues in the surveys.
2. The panelists are awarded Reward Points for providing their honest opinion in the surveys and the reward points can either be encashed or used to buy products available on the SpeakAsiaOnline web site.
3. There is no compulsion to offer an opinion and do the surveys - if you work and do the surveys you earn reward points, else you do not earn.
4. There is no compulsion to rope in any panelists or members either and the reward points are not tied to bringing in any members - again this is voluntary.

Your readers will find the definition of a Collective Investment Scheme here :
http://en.wikipedia.org/wiki/Collective_...

Your readers will find the definition of a Ponzi scheme here :
http://en.wikipedia.org/wiki/Ponzi_schem...

Your readers will find the definition of a Pyramid scheme here :
http://en.wikipedia.org/wiki/Pyramid_sch...

Your readers will fund the definition of a MLM Scheme here :
http://en.wikipedia.org/wiki/Multi-level...

In light of the above mentioned, let your educated readers decide for themselves whether SpeakAsiaOnline fits the definition of any of the ulterior schemes mentioned by you.

Another point I wish to make is this :
Even if we agree hypothetically with your contention that SpeakAsiaOnline is a fraud company then why on earth would it call a press conference to explain it's business model to the media and give you the opportunity to ask all the questions you have ? (I still remember your journalist representative being extremely antagonistic in asking questions during that press conference).

The Ministry of Company Affairs Chief clearly stated on a news channel many days ago that SpeakAsiaOnline cannot be investigated because it is not established in India.

Moreover, why would a so called "fraud" company be interested in seeking the relevant permissions from the Government to set up a Permanent Establishment in India when there is no need to do so ?

I am sure you have understood the business model because you seem an intelligent person but you still wish to malign this company in the garb of exposing so called fraud companies.

If any of your readers chooses to use some logic they will easily figure out for themselves that any company having the slightest ulterior motives would wind up and get scarce as soon as the heat is on them - but obviously that has not happened since the past 8 months of relentless mud slinging by the media which seems to be making you and your team more frustrated and leading you to indulge in irresponsible and biased journalism.

I have read almost all your articles so far about SpeakAsiaOnline but none of them has anything concrete which can justify or prove that SpeakAsiaOnline is a fraud company.

Your articles seem to have served only two purposes to me :
1. Create confusion and doubts in the mind of people who do not understand the business model of SpeakAsiaOnline and
2. Satisfy your ego that you are doing something to help in bringing to book alleged culprits perpetrating a fraud.

So may I request you to channel your energies towards more responsible and newsworthy journalism please ?

Thank you for providing a forum to express personal views in each of your articles.

Pyramid Alerts 11 months ago  in reply to Shabbir Haidermota
http://pyramidschemealert.org/

They lead the newcomers to believe it is all possible with the MLM system.

Some of the MLM leaders, it turns out, make the majority of their money as speakers and promoters, not from selling products or services. This is kept secret from the recruits who think the leaders became millionaires as salespeople for the company and are worthy role models.

Indian regulations have been heaven for companies floating IPO's,unsecured debentures/fixed deposits, plantation schemes, timeshares. The promoters quietly sat with the money and the authorities had other engagements.
The govt if it takes action can ensure a lot of these funds lost by the investors to be returned to them. Many of these companies are sitting on a lot of assets directly or indirectly.

The small state of Kerala is now shaking with NETWORKING FRAUD scam. A company called BIZARRE said to be swindled 200 crores of rupees from the people. A company named Tycoon swindled 370 crores (apprx.). Another MLM company, Nano Excel looted more than 600 crores. A foreign company (Malaysia) Unipay2u gulped about 100 crores.

The Police have closed and sealed offices of all networking companies operating in Kerala. An MLM company RMP went to the High Court of Kerala against Police action but the Hon. High Court did not give them any relief. The High Court gave the Police green signal with their anti- money laundering actions.

The Chief Minister yesterday directed the Police not to allow any NETWORKING company meeting in any hotels. All network marketing companies need to get permission from the Police.

Moreover, the Government of Kerala will be taking action against all software companies who are developing software for money chain/NETWORKING COMPANIES.

It is really surprising that why our national media is not highlighting the humongous networking fraud that had taken place in Kerala.

I do not know what the government is doing and not catching the culprits who are still fooling the hapless people in the name of giving a job??!! But what can we expect from this UPA government who are already knee deep in corruption scandals---Speak Asia is just another leaf in their page. So who bothers about them....!!

Someone from Speak Asia said, "Because we paid service tax, RBI will not create any problem".

Huh!! If that be so, then there would not have be scores of money laundering and FERA Violation cases against peoples, firms, going concerns, etc..

You people need not to teach me, about the pyramid schemes!! I have seen lot of them in the last 10-15 years and also see how people lose everything through such schemes.

A company which charges Rs.11000 to give a make belief job and then recruits people, in binary plans to bring more and more, "Murgas" (idiots) need not speak big.

Have you heard of people buying the shares of Reliance Industries Ltd to get a job in RIL---there should be a limit to absurdity.

I know you all will be caught....just wait.!! And you would be put behind the bars under, IPC Section, 415 for Cheating. The details of the section is given below:
"Cheating whoever by deceiving any person, fraudulently or dishonestly induces the person so deceived to deliver any property to any person, or to consent that any person shall retain any property, or intentionally induces the person so deceived to do or omit to do anything which he would not do omit if he were not so deceived, and which act or omission causes or is likely to cause damage or harm to that person in body, mind, reputation or property, is said to "cheat".

Another thing which I want to mention, Sucheta Dalal should now put a screening facility for the comments here, like TOI or Money Control or many such portals do, or else these people could continue their abuse and advertisement here, at the behest of Money Life. Just cut the tails of these dishonest Speak Asians. Don't let them advertise in your site.

Just chuck out all these garbages....Let these CAs and ICWAIs, go to the US and clean the toilets---they are high paying job man...!! You will get better value for your degrees. ..

Shame up on these bunch of goons and vampires...!!

You are still ignorant on the business model of Speak Asia and on the other side you calling it a pyramid scheme. Update your knowledge and don't try to protect your shareholder clients, who are planning to change their base to Speak Asia.

As far as the 500% return of investment you are blaming as the violation of RBI guidelines, come out from cost-benefit analysis leave it for the shares and bonds, for your info, it is not return on investment, it is only emolument some one gets by giving one's opinion after payment of registration fees of Rs.1000/- and one year subscription of Rs.10,000/-. And why 500%, if you seriously comapare, it may jump to 800% to 1000% in a year if you only stick to the cost-benifit analysis. In speak Asia, the consumer is seller and the not company. Are you, still unware of the shocks of consumerism, which is going to create tsunami in coming few months. Plsease also save the old ebay and other shopping cart systems who are going to be restricted in the US only.

If you still want to compare the SAOL with other compititors like Star Panel, I want to update you that Speak Asia is not creating fake accounts of the panelists like Star Panel, which is not taking any surveys from the panelists, pays nothing to the panelists and just creating the free and fake accounts to lure the big clients.

Good Luck, C, yaa in my downline.
